Terms and Conditions

    1. fastconnect.co.nz is a trading name of Fast Connect Limited (NZ company number 1857388). In these terms, “Fast Connect”, “us”, “we” or “our” means Fast Connect Limited or its related bodies corporate; references to the "website" means the Fast Connect website at https://fastconnect.co.nz/; and references to "Applicant" or "you" means individuals seeking and / or receiving services from us.
  2. TERMS
    1. These terms and conditions, together with our Privacy Policy and any additional terms, notices and disclaimers displayed on the website (Terms) govern your access to and use of the services offered by us.
    2. By proceeding to utilise our website and services, you confirm that you have read and agree to be bound by the Terms.
    3. We reserve the right to change or amend the Terms at any time. If we make any changes, the new Terms will be published on our website. Your subsequent or continued use of the website will constitute your acceptance of any changes to the Terms. If you object to any changes to the Terms, your only remedy is to immediately discontinue your use of the website.
    1. Fast Connect provides an application lodgement service only. Applicants are solely responsible for all fees, charges and tariff payments in respect to connections, account establishments, bonds and usage to all retailers.
    2. Our services include connection and comparison of utility and other products and services such as energy and telecommunications through our website and through our third-party retailer partners.
    3. We may sub-contract some of our services and utilise the services of third parties to fulfil some of our services to our customers.
    1. We do not represent all retailers in the market and therefore may not offer or discuss with you all of the products and services offered in the market or all of the products and services offered by each retailer. We are only able to offer information to our customers on the products and services that are made available to us by the retailers. We may change retailers from time to time and we do not guarantee that we can offer the product or service of any particular retailer.
    2. We are reliant on retailers to provide up to date pricing and product information. To the extent permitted by law, we are not responsible for any pricing or product changes made by a retailer or any inaccurate information retailers provide us. Savings shown on our website or discussed with you are based on the information provided by you and the information provided to us by retailers. The savings are indicative and we do not warrant their accuracy.
    3. You are solely responsible for choosing a retailer or agreeing to proceed with a retailer recommended on our website or by our call centre staff. Fast Connect will advise Applicants of available retailer and tariff options to the best of our ability but we make no warranty as to the cost competitiveness or suitability of any retailer services for your use.
    4. Information supplied by you is taken as accurate. We will not verify the accuracy of the information or data supplied by you.
    5. You may be charged a cancellation fee by your existing retailer if you cancel your existing service. In the event connections to retailers are cancelled, you remain responsible for all payments to retailers incurred between connection and cancellation. We recommend that you consider the costs associated with switching retailers before making the decision to do so.
    6. It is your responsibility to obtain and be familiar with all retailer conditions of supply before entering into a supply contract. Retailers supply and charge for their services under their standard conditions of supply as amended by them from time to time. Charges may include a security bond, connection fee, account establishment fee, usage charges, callout and installation fees and other charges as applicable from time to time.
    7. Fast Connect has no responsibility for the performance of the retailers in regard to connections, charges or supply, including delays and discontinuity of supply.
    1. Fast Connect is able to arrange the disconnection of services with preferred suppliers and under the condition the Applicant(s) are not under any fixed term contract.
    2. You acknowledge that we facilitate the connection of utility services with retailers but we are not responsible for the actual connection or disconnection of these services. We do not accept any liability for the connection or disconnection of services by retailers.
    3. Once a connection has been established with a retailer, you should direct any queries in relation to the products or services to the retailer, including any queries in relation to payment, debts, billing and monitoring.
    1. In order to operate our business efficiently and to provide our services to you, we may need to collect your personal information. You authorise and consent to us using and disclosing your personal information in accordance our Privacy Policy and these Terms.
    2. We may need to disclose your information to third party partners and retailers for the purpose of providing our services and for the connection or disconnection of your utilities (retailers may require a credit check to assess your credit worthiness). By submitting your application, you consent for us to disclose your information.
    1. Nothing in this section, or these Terms generally, affects any rights you may have under the Fair Trading Act 1986 and Consumer Guarantees Act 1993.
    2. We exclude all implied conditions and warranties from the use of our services, except any condition or warranty which cannot by law be excluded (“Non-excludable Condition“).
    3. Subject to clause 7.1, we will not be liable under any circumstances for any loss or damage of any kind (whether under contract, or otherwise) which arise from:
      1. you using or acquiring, or your inability to use or acquire, any service or product contained or referred to on the website or discussed on a call with one of our representatives and/or any linked sites on the website;
      2. errors, defects or omissions on the website or on a call with one of our representatives;
      3. delays to, interruptions of or cessation of the services provided on the website or on a call with one of our representatives;
      4. you acting, or failing to act, on any information contained on or referred to on the website or on a call with one of our representatives; or
      5. for any other reason permitted by law.
    4. To the maximum extent permitted by law, we limit any liability for breach of any Non-excludable Condition and/or breach of these Terms to the cost of re-supplying our connection services to you or payment of the cost of a third party supplying equivalent connection services to you.
    5. Neither of us will, in any circumstances, be liable to the other for any indirect or consequential losses, loss of profits, loss of revenue or loss of business opportunity.
    6. By using the website, you agree that the limitations of liability set out in these Terms are reasonable and accept our services on this basis.
    7. If you use our services for any business purposes, you agree the provisions of the Consumer Guarantees Act 1993 will not apply.
    1. We will not charge you for the use of our services.
    2. We receive, either directly or indirectly, commissions from retailers for successful connections. The commission that we receive is sometimes shared with third parties like real estate agents, our related bodies corporate, or associated businesses who may have referred you to us or to our website.
    1. This agreement is between Fast Connect Limited and the users of the website.
    2. These terms and conditions are governed by the laws of New Zealand.
